1. Agreement to Terms

Welcome to Travedeus. By accessing or using our travel agency website builder platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

Travedeus ("we," "us," or "our") provides a software-as-a-service platform that enables travel agencies to create, manage, and operate professional websites for their businesses.

2. Eligibility

To use Travedeus, you must:

Be at least 18 years of age
Have the legal authority to enter into these Terms
Operate a legitimate travel agency or related business
Provide accurate and complete registration information
Not be prohibited from using our Service under applicable laws

3. Account Registration and Security

Account Creation: You must create an account to use Travedeus. You agree to provide accurate, current, and complete information during registration and to update it as necessary.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.

One Account Per User: Each account is for individual or single business use. You may not share your account credentials or allow multiple users to access a single account unless you have a team plan.

Account Termination: We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities.

4. Subscription Plans and Billing

Subscription Tiers: Travedeus offers various subscription plans with different features and limitations. Current pricing and plan details are available on our website.

Billing Cycle: Subscriptions are billed on a monthly or annual basis, depending on your selected plan. Billing occurs automatically on the renewal date.

Payment Methods: You must provide a valid payment method to maintain an active subscription. You authorize us to charge your payment method for all fees incurred.

Price Changes: We may modify subscription prices with at least 30 days' notice. Continued use of the Service after price changes constitutes acceptance of the new pricing.

Refunds: Subscription fees are generally non-refundable except where required by law or at our sole discretion. We may provide pro-rata refunds for annual subscriptions canceled within the first 30 days.

Failed Payments: If payment fails, we may suspend your account until payment is successfully processed. Repeated payment failures may result in account termination.

5. Free Trials

We may offer free trials for certain subscription plans. Free trials are limited to one per customer and require a valid payment method. Unless canceled before the trial ends, your subscription will automatically convert to a paid plan and your payment method will be charged.

6. Acceptable Use Policy

You agree to use Travedeus only for lawful purposes and in accordance with these Terms. You agree NOT to:

Violate any applicable laws, regulations, or third-party rights
Upload or distribute malicious code, viruses, or harmful software
Use the Service to transmit spam, phishing attempts, or fraudulent content
Infringe on intellectual property rights of others
Harass, abuse, threaten, or discriminate against others
Impersonate any person or entity or misrepresent your affiliation
Attempt to gain unauthorized access to our systems or other users' accounts
Use automated systems (bots, scrapers) without our written permission
Create travel websites that promote illegal activities, scams, or fraudulent services
Overload or interfere with the proper functioning of our Service
Reverse engineer, decompile, or attempt to extract source code from our platform
Resell or redistribute the Service without authorization

7. Your Content and Data

Ownership: You retain all ownership rights to the content you create and upload to your travel agency websites ("Your Content"). This includes text, images, videos, itineraries, booking information, and other materials.

License to Us: By using Travedeus, you grant us a limited, worldwide, non-exclusive license to host, store, reproduce, and display Your Content solely to provide and improve our Service.

Responsibility: You are solely responsible for Your Content and the consequences of posting or publishing it. You represent that you have all necessary rights to Your Content and that it does not violate any laws or third-party rights.

Prohibited Content: Your Content must not include:

Illegal, fraudulent, or deceptive information
Content that infringes intellectual property rights
Malicious code or security threats
Adult content or content harmful to minors
Hate speech, harassment, or discriminatory material
Private information of others without consent

Backup: While we maintain regular backups, you are responsible for maintaining your own backup copies of Your Content.

Content Removal: We reserve the right to remove or disable access to any content that violates these Terms or applicable laws.

8. Intellectual Property Rights

Our Property: Travedeus, including its software, design, features, functionality, text, graphics, logos, and trademarks, is owned by us and protected by copyright, trademark, and other intellectual property laws.

Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use Travedeus solely for its intended purpose. This license terminates upon account cancellation or violation of these Terms.

Restrictions: You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract source code.

Feedback: If you provide suggestions, ideas, or feedback about Travedeus, we may use such feedback without obligation or compensation to you.

9. Third-Party Services and Integrations

Travedeus may integrate with third-party services such as payment processors, booking systems, analytics tools, and marketing platforms. Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the performance, reliability, or practices of third-party services.

10. Website Hosting and Uptime

Service Availability: We strive to maintain 99.9% uptime for websites built with Travedeus, but we do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible.

No Guarantee: We provide the Service "as is" and make no guarantees regarding availability, reliability, or performance.

Website Content Responsibility: You are responsible for ensuring your travel agency website complies with all applicable laws, including consumer protection, travel industry regulations, and booking terms.

11. Custom Domains

If you connect a custom domain to your Travedeus website, you are responsible for domain registration, renewal, and DNS configuration. We are not responsible for domain-related issues or expiration.

12. Data Security and Privacy

We implement reasonable security measures to protect your data, as described in our Privacy Policy. However, no system is completely secure, and we cannot guarantee absolute security. You acknowledge the inherent risks of transmitting data over the internet.

13. Disclaimers and Limitations of Liability

AS IS: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

NO GUARANTEE: WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAVEDEUS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

MAXIMUM LIABILITY: OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow limitations on implied warranties or liability for certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Travedeus and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

Your violation of these Terms
Your violation of any law or third-party rights
Your Content or websites created with Travedeus
Your negligence or willful misconduct
Disputes between you and your customers or clients

15. Termination

By You: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

By Us: We may suspend or terminate your account immediately if you violate these Terms, fail to pay fees, or engage in conduct that we reasonably believe is harmful to other users or our Service.

Effect of Termination: Upon termination:

Your access to the Service will cease
Your websites will be taken offline
We may delete Your Content after a reasonable period (typically 30 days)
You remain responsible for any unpaid fees
Sections of these Terms that by their nature should survive will continue to apply

Data Export: You may export Your Content before termination. We are not obligated to retain or provide Your Content after the retention period.

16. Modifications to Service and Terms

Service Changes: We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

Terms Changes: We may update these Terms periodically. We will notify you of material changes by email or through the Service. Your continued use after changes constitutes acceptance of the modified Terms.

Objection to Changes: If you do not agree to modified Terms, you must stop using the Service and cancel your subscription.

Relationship: These Terms do not create a partnership, joint venture, employment, or agency relationship between you and Travedeus.

21. Specific Terms for Travel Industry Compliance

Travel Services Disclaimer: Travedeus provides website building tools only. We do not provide travel services, booking services, or act as a travel agent. You are responsible for:

Obtaining necessary licenses and permits to operate as a travel agency
Complying with travel industry regulations in your jurisdiction
Providing accurate travel information and pricing to your customers
Honoring bookings and commitments made through your website
Maintaining adequate insurance for your travel business

Customer Disputes: Disputes between you and your customers are your sole responsibility. We are not liable for booking issues, travel disruptions, refund disputes, or customer complaints related to travel services you provide.

Payment Processing: If you process payments through your Travedeus website, you are responsible for PCI compliance and securing customer payment information according to industry standards.

By using Travedeus, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
